A few weeks ago NJCJI highlighted what we considered to be a ridiculous lawsuit against Chobani accusing it of misleading consumers because the company’s Greek yogurt isn’t made in Greece. While it still seems ridiculous to us, across the pond a very similar lawsuit has made its way all the way to Britain’s High Court. Chobani has lost the British case, which was brought by the Greek company Fage, who happens to be Chobani’s biggest competitor in the U.K.

 

Hopefully the U.K. decision does not serve as a model for the federal court in New York tasked with hearing the U.S. case. Creating a precedent for allowing this sort of label based litigation would only add to the growing number food based class actions, many of which are filed in New Jersey.
